    AN ACT concerning local government.
 
    Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
 
    Section 5. The Illinois Municipal Code is amended by adding
Section 11-6-7 as follows:
 
    (65 ILCS 5/11-6-7 new)
    Sec. 11-6-7. Annexation; intergovernmental agreement.
    (a) Whenever an unincorporated parcel of land that is
within the boundaries of a fire protection district is annexed
into the corporate limits of a municipality with a municipal
fire department, the municipal fire department and the fire
protection district may negotiate an intergovernmental
agreement to allow the fire protection district to have
jurisdiction over the annexed parcel in such instances when it
is not economically feasible for the municipal fire department
to have jurisdiction over the annexed property or when the
municipal fire department has determined that a hardship exists
that would compromise the safety and well-being of the annexed
property. If no agreement is adopted by both the municipality
and fire protection district, then the automatic transfer of
jurisdiction from the fire protection district to the
municipality shall occur upon annexation.
    (b) This Section is repealed 12 months after becoming law,
or on June 30, 2012, whichever is first.
 
    Section 99. Effective date. This Act takes effect upon
becoming law.
