    AN ACT concerning caller identification.
 
    Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
 
    Section 1. Short title. This Act may be cited as the
Internet Caller Identification Act.
 
    Section 5. Definition. As used in this Act:
    "Caller identification" means the display of the caller's
telephone number or identity to the recipient of the call.
 
    Section 10. Internet caller identification. No person,
other than the recipient of the call, shall use any Internet
caller identification equipment or Internet phone equipment in
such a manner as to make a number or name, other than the
residential or business phone number or legal or business name
of the subscriber or registered user of the Internet phone
service, appear on a caller identification system of the
recipient of the call. This Section does not apply to service
providers who transmit caller identification information
created or supplied by others.
 
    Section 15. Violations. Whenever any person knowingly uses
or has knowingly used any Internet caller identification
equipment or Internet phone equipment in violation of this Act,
that use shall be deemed an unlawful act or practice under the
Consumer Fraud and Deceptive Business Practices Act. In the
case of the use of Internet caller identification or Internet
phone equipment in violation of this Act, all remedies,
penalties, and authority available to the Attorney General and
the several State's Attorneys under the Consumer Fraud and
Deceptive Business Practices Act for the enforcement of that
Act shall be available for the enforcement of this Act.
 
    Section 85. The Consumer Fraud and Deceptive Business
Practices Act is amended by changing Section 2Z as follows:

    Sec. 2Z. Violations of other Acts. Any person who knowingly
violates the Automotive Repair Act, the Automotive Collision
Repair Act, the Home Repair and Remodeling Act, the Dance
Studio Act, the Physical Fitness Services Act, the Hearing
Instrument Consumer Protection Act, the Illinois Union Label
Act, the Job Referral and Job Listing Services Consumer
Protection Act, the Travel Promotion Consumer Protection Act,
the Credit Services Organizations Act, the Automatic Telephone
Dialers Act, the Pay-Per-Call Services Consumer Protection
Act, the Telephone Solicitations Act, the Illinois Funeral or
Burial Funds Act, the Cemetery Care Act, the Safe and Hygienic
Bed Act, the Pre-Need Cemetery Sales Act, the High Risk Home
Loan Act, the Payday Loan Reform Act, the Mortgage Rescue Fraud
Act, subsection (a) or (b) of Section 3-10 of the Cigarette Tax
Act, the Payday Loan Reform Act, subsection (a) or (b) of
Section 3-10 of the Cigarette Use Tax Act, the Electronic Mail
Act, the Internet Caller Identification Act, paragraph (6) of
subsection (k) of Section 6-305 of the Illinois Vehicle Code,
Article 3 of the Residential Real Property Disclosure Act, the
Automatic Contract Renewal Act, or the Personal Information
Protection Act commits an unlawful practice within the meaning
of this Act.
