    AN ACT concerning education.
 
    Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
 
    Section 5. The School Code is amended by adding Sections
10-20.39 and 34-18.30 as follows:
 
    (105 ILCS 5/10-20.39 new)
    Sec. 10-20.39. Highly qualified teachers; No Child Left
Behind Act funds. If a school district has an overall shortage
of highly qualified teachers, as defined by the federal No
Child Left Behind Act of 2001 (Public Law 107-110), or a
shortage of highly qualified teachers in the subject area of
mathematics, science, reading, or special education, then the
school board must spend at least 40% of the money it receives
from Title 2 grants under the Act on recruitment and retention
initiatives to assist in recruiting and retaining highly
qualified teachers (in a specific subject area if applicable)
as specified in paragraphs (1)(B), (2)(A), (2)(B), (4)(A),
(4)(B), and (4)(C) of subsection (a) of Section 2123 of the Act
until there is no longer a shortage of highly qualified
teachers (in a specific subject area if applicable). As the
number of highly qualified teachers in the district increases,
however, the school board may spend any surplus of the minimum
40% of funds dedicated to addressing the highly qualified
teacher shortage in any manner the school board deems
appropriate.

    Sec. 34-18.30. Highly qualified teachers; No Child Left

shortage of highly qualified teachers, as defined by the

or a shortage of highly qualified teachers in the subject area

    Section 99. Effective date. This Act takes effect upon
becoming law.
