CHAPTER II: SECRETARY OF STATE PART 1040 CANCELLATION, REVOCATION OR SUSPENSION OF LICENSES OR PERMITS SECTION 1040.41 SUSPENSION OF LICENSES FOR CURFEW OR NIGHT TIME DRIVING RESTRICTION VIOLATIONS
Section 1040.41 Suspension of Licenses for Curfew or Night Time Driving Restriction Violations
a) A person who is under the age of 17 years is in violation of IVC Section 6-110(a) or 6-107.1(b) if he/she operates a motor vehicle on any highway during any time the licensee is prohibited from being in a public place because of curfew.
b) A person is in violation of IVC Section 6-107.1(b) or 6-110(a-1) if he/she operates a motor vehicle on any highway during night time driving restriction.
c) The Department shall take the following action pursuant to IVC Section 6-206(a)(13) for curfew or night time driving restriction violation convictions:
1) 1st Conviction – 60-day suspension
2) 2nd Conviction – 90-day suspension
3) 3rd Conviction or more – 6-month suspension
