Sec. 1710-20.
Mental Health and Developmental Disabilities Code.
(a) The Department has the power to administer the provisions of
the
Mental Health and Developmental
Disabilities Code that pertain to the responsibilities of the
Department.
(b) The Department has the power to initiate injunction
proceedings wherever it appears to the
Secretary that any
person, group of persons, or corporation is engaged or about to engage
in any acts or practices that constitute or will constitute a
violation
of the Mental Health and Developmental Disabilities Code or any rule or
regulation prescribed under authority of that Code. The
Secretary may, in his or her discretion,
through the Attorney General, file a complaint and apply for an injunction,
and upon a proper showing, any circuit court may issue a permanent or
preliminary injunction or a temporary restraining order without bond to
enforce that Code, rule, or regulation in addition to the
penalties and other remedies provided
in that Code, rule, or regulation. Either party may
appeal as in other civil cases.
