    AN ACT concerning business.
 
    Be it enacted by the People of the State of Illinois, 
represented in the General Assembly:
 
    Section 5. The Home Repair and Remodeling Act is amended 
by adding Section 31 as follows:
 
    (815 ILCS 513/31 new)
    Sec. 31. Attorney's fees. If a home repair and remodeling 
contract that is subject to this Act contains a provision 
allowing attorney's fees to be awarded to any party to the 
contract, then, notwithstanding any terms in the contract to 
the contrary, that provision shall be deemed and construed to 
permit the award of reasonable attorney's fees to all parties 
to the contract. This Section applies to any home repair and 
remodeling contract executed on and after the effective date 
of this amendatory Act of the 104th General Assembly.
 
    Section 99. Effective date. This Act takes effect upon
