HOUSE JOINT RESOLUTION

 
2    WHEREAS, Community Integrated Living Arrangements (CILAs),
3or group homes, provide community-based housing and essential
4support for nearly 10,336 adults with intellectual and
5developmental disabilities (I/DD) across Illinois, many of
6whom require extensive supervision and care; and
 
7    WHEREAS, The State of Illinois is under the Ligas Consent
8Decree, requiring expanded access to community-based services
9for individuals with I/DD, and has repeatedly been found out
10of compliance; and
 
11    WHEREAS, The Illinois Department of Human
12Services-Division of Developmental Disabilities (DHS-DDD)
13Guidehouse Rate Study, published in 2020, outlined several
14I/DD rate changes based on approved recommendations by the
15Ligas Rates Oversight Committee; from 2021 to 2025, DHS has
16implemented portions of the rate study, and the General
17Assembly has made significant investments into the I/DD
18community system; and
 
19    WHEREAS, Beginning January 1, 2026, the final FY26 budget
20for the State of Illinois eliminates $11.2 million in funding
21for CILA providers, reducing services for all 24-hour CILA
22residents, thereby threatening care quality and compliance

1with federal home and community-based services regulations;
2and
 
3    WHEREAS, Removing this funding from the I/DD system is a
4piecemeal approach that does not consider the wholistic
5funding needs presented in the DHS-DDD Guidehouse Rate Study
6that exist as result of the Ligas Consent Decree; and
 
7    WHEREAS, Cuts to CILA Direct Support Professional (DSP)
8service hours will result in reductions in services for people
9with I/DD, particularly those with the most intense needs,
10resulting in high levels of system destabilization and service
11degradation over the long term; and
 
12    WHEREAS, Some crucial priorities contained within the
13DHS-DDD Guidehouse Rate Study remain fully unfunded such as
14the "Zero Hour" Staffing Model, which funds staff for 24 hours
15a day, seven days a week and would add 2.4 million DSP service
16hours into the system; and
 
17    WHEREAS, Removing CILA DSP Service hours from the State's
18I/DD system as is contained within the FY26 final budget, only
19to reinsert CILA DSP Service Hours associated with
20implementation of the "Zero Hour" Staffing Model at a future
21date, is budgetarily inefficient and unhealthy for system
22stability; and

1    WHEREAS, Significant cuts to Medicaid and other federal
2programs that provide care to thousands in Illinois in the
3I/DD community have created great uncertainty for individuals,
4families, providers, lawmakers, and advocates, and more time
5is needed to fully understand and plan for those impacts on
6I/DD services; therefore, be it
 
7    RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE
8HUNDRED FOURTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE
9SENATE CONCURRING HEREIN, that we urge the Illinois Department
10of Human Services and the Pritzker Administration to delay
11cuts to Direct Service Professional (DSP) service hours set to
12begin January 1,2026, until such time as the State is prepared
13to implement the "Zero Hour" Staffing Model, to protect the
14services depended on by individuals with intellectual and
15developmental disabilities (I/DD); and be it further
 
16    RESOLVED, That suitable copies of this resolution be
17delivered to the Governor, the Speaker and Minority Leader of
18the Illinois House of Representatives, the President and
19Minority Leader of the Illinois Senate, and the Illinois
20Department of Human Services-Division of Developmental
21Disabilities.
