| 1 | AN ACT concerning education. | ||||||||||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois, | ||||||||||||||||||||||||||
| 3 | represented in the General Assembly: | ||||||||||||||||||||||||||
| 4 | Section 5. The School Code is amended by changing Sections | ||||||||||||||||||||||||||
| 5 | 10-20.28 and 34-18.14 as follows: | ||||||||||||||||||||||||||

| 7 | Sec. 10-20.28. Cellular radio telecommunication devices. | ||||||||||||||||||||||||||
| 8 | (a) The General Assembly finds and declares that the | ||||||||||||||||||||||||||
| 9 | educational development of all persons to the limits of their | ||||||||||||||||||||||||||
| 10 | capacities is a fundamental goal of the people of this State | ||||||||||||||||||||||||||
| 11 | and that to achieve such goal it is essential to provide a safe | ||||||||||||||||||||||||||
| 12 | and secure learning environment within the public schools. | ||||||||||||||||||||||||||
| 13 | While recognizing that cellular radio telecommunication | ||||||||||||||||||||||||||
| 14 | devices may be used for inappropriate activities during school | ||||||||||||||||||||||||||
| 15 | hours and on school property and may, on occasion, cause | ||||||||||||||||||||||||||
| 16 | disruption to the classroom environment, the General Assembly | ||||||||||||||||||||||||||
| 17 | also recognizes that the use of cellular radio | ||||||||||||||||||||||||||
| 18 | telecommunication devices can decrease the response time of | ||||||||||||||||||||||||||
| 19 | officials to emergency situations. In addition, cellular radio | ||||||||||||||||||||||||||
| 20 | telecommunication devices allow parents an additional and | ||||||||||||||||||||||||||
| 21 | timely method of contacting their children should an emergency | ||||||||||||||||||||||||||
| 22 | situation arise. Therefore, it is the purpose and intention of | ||||||||||||||||||||||||||
| 23 | the General Assembly in enacting this legislation to (i) | ||||||||||||||||||||||||||

| 1 | reduce the occurrence of inappropriate and disruptive | ||||||
| 2 | activities during school hours and on school property | ||||||
| 3 | occurring through the use of cellular radio telecommunication | ||||||
| 4 | devices and (ii) increase the safety of students and school | ||||||
| 5 | personnel during school hours and on school property. | ||||||
| 6 | (b) A The school board shall may establish appropriate | ||||||
| 7 | rules and disciplinary procedures governing the use or | ||||||
| 8 | possession of cellular radio telecommunication devices by a | ||||||
| 9 | student while in a school or on school property, during | ||||||
| 10 | regular school hours, or at any other time, including, but not | ||||||
| 11 | limited to, rules that restrict the use of cellular radio | ||||||
| 12 | telecommunication devices during instructional time. The | ||||||
| 13 | school board may create exceptions to these rules, including, | ||||||
| 14 | but not limited to, exceptions for school-based emergencies, | ||||||
| 15 | individual student and family emergencies, and individualized | ||||||
| 16 | education program and federal Section 504 plan accommodations | ||||||
| 17 | and to allow for teacher discretion. | ||||||
