AMENDMENT TO HOUSE BILL 4993




2    AMENDMENT NO. ______. Amend House Bill 4993 by replacing 
3everything after the enacting clause with the following:



 
4    "Section 5. The Criminal Code of 2012 is amended  by adding 
5Section 24-2.3 as follows:
 
6    (720 ILCS 5/24-2.3 new)
7    Sec. 24-2.3. Possession of explosive substances.
8    (a) A person commits possession of explosive substances 
9when he or she knowingly
possesses  triacetone triperoxide 
10(TATP) or hexamethylene
triperoxide diamine (HMTD).
11    (b) Nothing in this Section prohibits:
12        (1) the authorized manufacture, storage, handling, 
13    transportation, distribution, transfer, use, possession, 
14    or disposal of any
material, substance, or device by a 
15    member of the armed forces of the United States, fire

16    fighters, or law enforcement officers; or

1        (2) the authorized manufacture, storage, handling, 
2    transportation, distribution, transfer, use, possession, 
3    or disposal of any
material, substance, or device to be 
4    used solely for scientific research, educational purposes, 
5    or for
any lawful purpose, subject to the provisions of the 
6    Illinois Explosives Act.
7    (c) Sentence. Possession of explosive substances is a Class 
84 felony.".
