AMENDMENT TO HOUSE BILL 1138

2    AMENDMENT NO. ______. Amend House Bill 1138 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Department of Transportation Law of the
5Civil Administrative Code of Illinois is amended by adding
6Section 2705-505.7 as follows:
 
7    (20 ILCS 2705/2705-505.7 new)
8    Sec. 2705-505.7. School zone speed limits; signs; notice.
9Before erecting any new signs regulating speed pursuant to
10Section 11-605 of the Illinois Vehicle Code or similar local
11ordinance, or changing the speed limit of a roadway within
122,000 feet of the primary entrance or entrances of a school or
13schools, the Department or body having jurisdiction over the
14roadway shall notify the principal of any schools within 2,000
15feet of the proposed action and the chief of the local law
16enforcement agency. The notice shall contain (i) a description

1of the proposed action, including the proposed speed limit
2changes and geography involved; and (ii) a contact person to
3whom comments may be submitted.
4    The Department or body having jurisdiction over the roadway
5shall provide at least 30 days notice of the proposed action
6and shall accept comments from any interested party for at
7least 30 days. The notice shall be in the form of a letter
8delivered by first class mail and may also be provided through
9other means. Upon request of a school district, any notice
10required by this Section shall be delivered to a designated
11contact at the district instead of to individual principals.
12Nothing in this Section shall prohibit forms of public notice,
13public comment, or public hearings in addition to those
14required by this Section.
15    This Section shall not apply in municipalities with a
16population over 1,000,000 persons.
 
17    Section 99. Effective date. This Act takes effect upon
18becoming law.".
