1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Safe and Hygienic Bed Act is amended by
5changing Section 5 as follows:
 
6    (410 ILCS 68/5)
7    Sec. 5. Definitions. As used in this Act:
8    "Attorney General" means the the Attorney General of the
9State of Illinois.
10    "Bedding" means any mattress, box spring, foundation, or
11studio couch made in whole or part from new or secondhand
12fabric, filling material, or other textile product or material
13and which can be used for sleeping or reclining purposes.
14    "Consumer" means a person who purchases or otherwise
15acquires bedding for sleeping or reclining purposes in that
16person's home or business such as a medical facility or lodging
17establishment, and does not include wholesalers, retailers, or
18other persons who acquire bedding for purposes of resale or
19other distribution.
20    "Department" means the Illinois Department of Public
21Health.
22    "Manufacturer" means a person who makes any article of
23bedding in whole or in part using new or secondhand fabric,

1filling material, or other textile product or material.
2    "New material" means any fabric, filling material, other
3textile product or material, or article of bedding that has not
4been previously used for any purpose, and includes by-products
5of any textile or manufacturing process that are free from
6dirt, insects, and other contamination.
7    "Person" means an individual, sole proprietorship,
8partnership, limited liability company, corporation, joint
9venture, association, trust, and any other entity, and the
10officers, employees, and agents of any of them.
11    "Renovator", "Rebuilder", and "Repairer" mean a person who
12repairs, makes over, recovers, restores, sanitizes,
13germicidally treats, cleans, or renews bedding.
14    "Sanitizer" means any person who sanitizes or germicidally
15treats or cleans (but does not otherwise alter) any fabric,
16filling material, other textile product or material, or article
17of bedding for use in manufacturing or renovating bedding.
18    "Secondhand material" means any fabric, filling material,
19other textile product or material, or article of bedding that
20has been previously used for any purpose or that is derived
21from post-consumer or industrial waste, and that may be used in
22place of or in addition to new material in manufacturing or
23renovating bedding.
