SYNOPSIS AS INTRODUCED:
 
70 ILCS 1290/2   from Ch. 105, par. 327

    Amends the Park District Aquarium and Museum Act. Provides that a resolution to levy and collect a tax for the maintenance of aquariums and museums in excess of 0.03 percent but not to exceed 0.15 percent (now, 0.07 percent) of the value of taxable property in the district must be published. Effective immediately.

1     AN ACT concerning revenue.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Park District Aquarium and Museum Act is
5 amended by changing Section 2 as follows:
 
6     (70 ILCS 1290/2)  (from Ch. 105, par. 327)
7     Sec. 2. Maintenance tax - Limitations - Levy and
8 collection. Each board of park commissioners, having control of
9 a public park or parks within which there shall be maintained
10 any aquarium or any museum or museums of art, industry, science
11 or natural or other history under the provisions of this Act,
12 is hereby authorized, subject to the provisions of Section 4 of
13 this Act, to levy annually a tax not to exceed .03 per cent in
14 park districts of less than 500,000 population and in districts
15 of over 500,000 population not to exceed .15 percent of the
16 full, fair cash value, as equalized or assessed by the
17 Department of Revenue of taxable property embraced in said
18 district, according to the valuation of the same as made for
19 the purpose of State and county taxation by the general
20 assessment last preceding the time when such tax hereby
21 authorized shall be levied: Such tax to be for the purpose of
22 establishing, acquiring, completing, erecting, enlarging,
23 ornamenting, building, rebuilding, rehabilitating, improving,

1 operating, maintaining and caring for such aquarium and museum
2 or museums and the buildings and grounds thereof; and the
3 proceeds of such additional tax shall be kept as a separate
4 fund. Said tax shall be in addition to all other taxes which
5 such board of park commissioners is now or hereafter may be
6 authorized to levy on the aggregate valuation of all taxable
7 property within the park district. Said tax shall be levied and
8 collected in like manner as the general taxes for such parks
9 and shall not be included within any limitation of rate for
10 general park purposes as now or hereafter provided by law but
11 shall be excluded therefrom and be in addition thereto and in
12 excess thereof. Provided, further, that the foregoing
13 limitations upon tax rates, insofar as they are applicable to
14 park districts of less than 500,000 population, may be further
15 increased or decreased according to the referendum provisions
16 of the General Revenue Law of Illinois.
17     Whenever the board of park commissioners of a park district
18 of less than 500,000 population adopts a resolution that it
19 shall levy and collect a tax for the purposes specified in this
20 Section in excess of .03 percent but not to exceed .15 .07
21 percent of the value of taxable property in the district, the
22 board shall cause the resolution to be published at least once
23 in a newspaper of general circulation within the district. If
24 there is no such newspaper, the resolution shall be posted in
25 at least 3 public places within the district. The publication
26 or posting of the resolution shall include a notice of (1) the

1 specific number of electors required to sign a petition
2 requesting that the question of the adoption of the resolution
3 be submitted to the electors of the district; (2) the time
4 within which the petition must be filed; and (3) the date of
5 the prospective referendum.
6     The secretary of the park district shall provide a petition
7 form to any individual requesting one.
8     Any taxpayer in such district may, within 30 days after the
9 first publication or posting of the resolution, file with the
10 secretary of the park district a petition signed by not less
11 than 10 percent or 1,500, whichever is lesser, of the electors
12 of the district requesting that the following question be
13 submitted to the electors of the district:
14     "Shall the .... Park District be authorized to levy an
15 annual tax in excess of .... but not to exceed .... as
16 authorized in Section 2 of "An Act concerning aquariums and
17 museums in public parks" for the purpose of establishing,
18 acquiring, completing, erecting, enlarging, ornamenting,
19 building, rebuilding, rehabilitating, improving, operating,
20 maintaining and caring for such aquariums and museum or museums
21 and the buildings and grounds thereof?" The secretary of the
22 park district shall certify the proposition to the proper
23 election authorities for submission to the electorate at a
24 regular scheduled election in accordance with the general
25 election law. If a majority of the electors voting on the
26 proposition vote in favor thereof, such increased tax shall

1 thereafter be authorized; if a majority of the vote is against
2 such proposition, the previous maximum rate shall remain in
3 effect until changed by law.

5     Section 99. Effective date. This Act takes effect upon
