AMENDMENT TO SENATE BILL 1176

2    AMENDMENT NO. ______. Amend Senate Bill 1176 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Department of Central Management Services
5Law of the Civil Administrative Code of Illinois is amended by
6adding Section 405-545 as follows:
 
7    (20 ILCS 405/405-545 new)
8    Sec. 405-545. State Retiree Medicare Primacy Coordination
9Audit and Assistance Program.
10    (a) Within 6 months after the effective date of this
11amendatory Act of the 103rd General Assembly, the Department
12of Central Management Services, in conjunction with the State
13Employees' Retirement System of Illinois, the State
14Universities Retirement System, the Teachers' Retirement
15System of the State of Illinois, the Judges Retirement System
16of Illinois, and the General Assembly Retirement System, may

1enter into a contract with a qualified and experienced
2administrator to establish and conduct a State Retiree
3Medicare Primacy Coordination Audit and Assistance Program to
4identify annuitants, retirees, benefit recipients, survivors,
5or dependents who are eligible for Medicare, but not enrolled
6in Medicare, and to assist those annuitants, retirees, benefit
7recipients, survivors, or dependents with enrolling in Social
8Security and Medicare.
9    (b) The State Retiree Medicare Primacy Coordination Audit
10and Assistance Program shall conduct an annual audit of the
11State health benefits program for everyone covered under the
12State Employees Group Insurance Program, the Teachers'
13Retirement Insurance Program, and the College Insurance
14Program for the purpose of identifying participants and their
15dependents who are eligible for Medicare under federal law.
16The Program shall also ensure that those annuitants, retirees,
17benefit recipients, survivors, or dependents who are eligible
18for Medicare are enrolled in Medicare with Medicare as their
19primary health care benefits coverage and the State Health
20Benefits Program being the secondary provider of their health
21care benefits coverage.
22    (c) The State Retiree Medicare Primacy Coordination Audit
23and Assistance Program shall assist any annuitant, retiree,
24benefit recipient, survivor or their dependents who becomes
25disabled, and is not enrolled in Social Security Disability
26Insurance and Medicare, with enrolling in and obtaining Social

1Security Disability Insurance and Medicare benefits. This
2assistance shall include, but not be limited to: (i)
3developing communication materials to educate individuals
4about Social Security Disability Insurance benefits; (ii)
5performing multiple outreaches to targeted populations; (iii)
6analyzing responses to determine Social Security Disability
7Insurance eligibility; and (iv) representing qualified
8individuals on their claim for Social Security Disability
9Insurance and Medicare.
10    (d) The administrator shall provide the Department, the
11State Employees' Retirement System of Illinois, the State
12Universities Retirement System, the Teachers' Retirement
13System of the State of Illinois, the Judges Retirement System
14of Illinois, the General Assembly Retirement System, and the
15General Assembly with an annual report showing the number of
16annuitants, retirees, benefit recipients, survivors, and
17dependents who are transitioned to Social Security Disability
18Insurance and Medicare and the amount of savings realized by
19the State of Illinois.
 
20    Section 99. Effective date. This Act takes effect on
21January 1, 2025.".
