HOUSE RESOLUTION

 
2    RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE
3HUNDREDTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that the
4Rules of the House of Representatives of the 100th General
5Assembly are amended by changing Rules 16 and 67, and adding by
6Rule 15.5 as follows:
 
7    (House Rule 15.5 new)
8    15.5 Committee on Rules of Organization and Procedure.
9    (a) The Committee on Rules of Organization and Procedure is
10created as a permanent committee. The Committee shall consist
11of 6 members, 3 appointed by the Speaker and 3 appointed by the
12Minority Leader. The Speaker and the Minority Leader are each
13eligible to be appointed to the Committee. The Committee may
14conduct business when a majority of the total number of its
15members has been appointed.
16    (b) The majority caucus members of the Committee shall
17serve at the pleasure of the Speaker, and the minority caucus
18members shall serve at the pleasure of the Minority Leader.
19Appointments shall be by notice filed with the Clerk, and shall
20be effective for the balance of the term or until a replacement
21appointment is made, whichever first occurs. Appointments take
22effect upon filing with the Clerk, regardless of whether the
23House is in session.
24    The Committee may, with the concurrence of a majority of

1those appointed, sponsor resolutions to adopt or amend rules of
2organization and procedure for the House or Joint House-Senate
3Rules. Notwithstanding any rule to the contrary, any resolution
4approved for consideration by the Committee, pursuant to a vote
5of a majority of those appointed, may be immediately considered
6by the House without referral to any committee.

8    (House Rule 16)
9    16. Referrals of Resolutions and Reorganization Orders.
10    (a) All resolutions, except adjournment resolutions and
11resolutions considered under subsection (b) or (c) of this
12Rule, after being initially read by the Clerk, shall be ordered
13reproduced and distributed as provided in Rule 39 and
14automatically referred to the Rules Committee, which may
15thereafter refer any resolution before it to the House or to a
16standing committee or special committee. No resolution, except
17adjournment resolutions and resolutions considered under
18subsection (b), (c), or (d) of this Rule, may be considered by
19the House unless (i) referred to the House by the Rules
20Committee under Rule 18, (ii) favorably reported by a standing
21committee or special committee, (iii) authorized under Article
22XII, or (iv) discharged from committee pursuant to Rule 18(g)
23or Rule 58, or (v) approved for consideration by the Committee
24on Rules of Organization and Procedure under subsection (a) of
25Rule 67. An adjournment resolution is subject to Rule 66.

1    (b) Any member may file a congratulatory or death
2resolution for consideration by the House. The Principal
3Sponsor of each congratulatory or death resolution shall pay a
4reasonable fee, determined by the Clerk with the approval of
5the Speaker, to offset the actual cost of producing the
6congratulatory or death resolution. The fee may be paid from
7the office allowance provided by Section 4 of the General
8Assembly Compensation Act, or from any other funds available to
9the member. Upon agreement of the Speaker and the Minority
10Leader, congratulatory or death resolutions may be immediately
11considered and adopted by the House without referral to the
12Rules Committee. Those resolutions may be adopted as a group by
13a single motion pursuant to a voice vote. A member may record a
14vote of "present" or "no" for a particular resolution by filing
15a notice with the Clerk to be included in the House Journal.
16Congratulatory and death resolutions shall be entered on the
17Journal only by number, sponsorship, and subject. The
18provisions of this subsection requiring the Principal Sponsor
19to pay a reasonable fee may not be suspended.
20    (c) Death resolutions in memory of former members of the
21General Assembly and former constitutional officers, upon
22introduction, may be immediately considered by the House
23without referral to the Rules Committee. Those resolutions
24shall be entered on the Journal in full.
25    (d) Executive reorganization orders of the Governor issued
26under Article V, Sec. 11 of the Constitution, upon being read

1into the record by the Clerk, are automatically referred to the
2Rules Committee for its referral to a standing committee or a
3special committee, which may issue a recommendation to the
4House with respect to the Executive Order. The Rules Committee
5may refer a resolution to disapprove an Executive Order to the
6House if a standing committee or a special committee has
7reported to the House on the Executive Order, or if the
8Executive Order has been discharged under Rule 58. The House
9may disapprove of an Executive Order by resolution adopted by a
10majority of those elected.

12    (House Rule 67)
13    67. Adoption and Amendment to or Suspension of Rules.
14    (a) Adoption of Rules. At the commencement of a term, the
15House shall adopt new rules of organization and procedure by
16resolution setting forth those rules in their entirety. The
17resolution must have been sponsored and approved for
18consideration by the Committee on Rules of Organization and
19Procedure, and it shall not be subject to amendment by the
20House. The resolution shall be adopted by the affirmative vote
21of a majority of those elected. These Rules of the House of
22Representatives are subject to revision or amendment only in
23accordance with this Rule.
24    (b) Rules may be amended only by resolution sponsored by
25the Committee on Rules of Organization and Procedure. Any

1resolution to amend these Rules or Joint House-Senate Rules
2shall show the proposed changes in the existing rules by
3underscoring all new matter and by crossing out with a line all
4matter that is to be omitted or superseded.
5    (b-5) For the purpose of the organization and operation of
6the House of Representatives, the rules adopted by and
7applicable to the regular session of the House of
8Representatives of the preceding General Assembly, insofar as
9such rules may be applicable, shall prevail and be the rules
10governing the House of Representatives of the General Assembly
11then convened, until (i) such rules are changed or new rules
12adopted, or (ii) the sixteenth day in the month of February in
13the odd-numbered year.
14    (c) (Blank.) Any resolution proposing to amend a House Rule
15or any Joint House-Senate Rule, upon initial reading by the
16Clerk, is automatically referred to the Rules Committee.
17Resolutions to amend the House Rules or any Joint House-Senate
18Rules may be initiated and sponsored by the Rules Committee and
19may be amended by the Rules Committee; those resolutions shall
20not be referred to a committee and may be immediately
21considered and adopted by the House. Those resolutions shall be
22assigned standard debate status, subject to Rule 52.
23    (d) (Blank.) A resolution to amend the House Rules or any
24Joint House-Senate Rules that has been reported "be adopted" or
25"be adopted as amended" by a majority of those appointed to the
26Rules Committee requires the affirmative vote of a majority of

1those elected for adoption by the House. Any other resolution
2proposing to amend the House Rules or any Joint House-Senate
3Rules requires the affirmative vote of 71 of the members
4elected for adoption by the House.
5    (e) No House Rule or any Joint House-Senate Rule may be
6suspended except by unanimous consent of the members present or
7upon a motion supported by the affirmative vote of a majority
8of those elected unless a higher number is required in the Rule
9sought to be suspended. A committee may not suspend any Rule.
10    (f) This Rule may be suspended only by the affirmative vote
11of 71 members elected.
