SYNOPSIS AS INTRODUCED:
 
50 ILCS 748/3

    Amends the Volunteer Emergency Worker Job Protection Act. Provides that "volunteer emergency worker" means a person who serves as a member of a fire department of a fire protection district, municipality, or other unit of government on other than a full-time career basis and who meets the requirements for volunteer status under the Code of Federal Regulations and Opinion Letters from the United States Department of Labor. Provides that "volunteer emergency worker" also means, including, but not limited to, a person who serves on a volunteer basis and is licensed under the Emergency Medical Services (EMS) Systems Act as an Emergency Medical Responder (EMR)(First Responder), Emergency Medical Technician (EMT), Emergency Medical Technician-Intermediate (EMT-I), Advanced Emergency Medical Responder (A-EMT), or Paramedic (EMT-P), or a volunteer ambulance driver or attendant, and the person does not work in one of these capacities for another fire department, fire protection district, or governmental entity on a full-time career basis. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Volunteer Emergency Worker Job Protection
5Act is amended by changing Section 3 as follows:
 
6    (50 ILCS 748/3)
7    Sec. 3. Definitions. As used in this Act:
8    "Volunteer emergency worker" means a person who serves as a
9member of a fire department of a fire protection district,
10municipality, or other unit of government on other than a
11full-time career basis and who meets the requirements for
12volunteer status provided in Section 553.106 of Title 29 of the
13Code of Federal Regulations and United States Department of
14Labor Wage and Hour Opinion Letter FLSA 2006-28 and United
15States Department of Labor Wage and Hour Opinion Letter FLSA
162005-51 firefighter who does not receive monetary compensation
17for his or her services to a fire department or fire protection
18district and who does not work for any other fire department or
19fire protection district for monetary compensation. "Volunteer
20emergency worker" also means, including, but not limited to, a
21person who serves on a volunteer basis and is licensed under
22the Emergency Medical Services (EMS) Systems Act as an
23Emergency Medical Responder (EMR)(First Responder), Emergency

1Medical Technician (EMT), Emergency Medical
2Technician-Intermediate (EMT-I), Advanced Emergency Medical
3Responder (A-EMT), or Paramedic (EMT-P), or a volunteer
4ambulance driver or attendant, and the person does not work in
5one of these capacities for another fire department, fire
6protection district, or governmental entity on a full-time
7career basis who does not receive monetary compensation for his
8or her services as a volunteer Emergency Medical Technician
9(licensed as an EMT, EMT-I, A-EMT, or Paramedic under the
10Emergency Medical Services (EMS) Systems Act), a volunteer
11ambulance driver or attendant, or a volunteer "Emergency
12Medical Responder", as defined in Sec. 3.50 of the Emergency
13Medical Services (EMT) Systems Act, to a fire department, fire
14protection district, or other governmental entity and who does
15not work in one of these capacities for any other fire
16department, fire protection district, or governmental entity
17for monetary compensation. "Volunteer emergency worker" also
18means a person who is a volunteer member of a county or
19municipal emergency services and disaster agency pursuant to
20the Illinois Emergency Management Agency Act, an auxiliary
21policeman appointed pursuant to the Municipal Code, or an
22auxiliary deputy appointed by a county sheriff pursuant to the
23Counties Code.
24    "Monetary compensation" does not include a monetary
25incentive awarded to a firefighter by the board of trustees of
26a fire protection district under Section 6 of the Fire
